The Parliament of the Republic of Moldova adopted in the Second Reading Amendments to the Law on the Protection of Inventions

06/13/2025

Chisinau, 13 June 2025 – The Parliament of the Republic of Moldova voted in the second reading the Draft Law amending Law No 50/2008 on the Protection of Inventions (Strengthening the Normative Framework Applicable to the Protection of Inventions).

The draft was developed in the context of Republic of Moldova’s intention to accede to the Convention on the Grant of European Patents, adopted in Munich in 1973, the new regulations also aiming at harmonizing national legislation with the provisions of relevant European Union acts in the field and implementing modern mechanisms for the protection of inventions, including supplementary protection certificates and compulsory licenses for pharmaceutical products intended for export to countries affected by public health problems.

The adoption of the amendments will allow the extension of the effects of the European patent on the territory of the Republic of Moldova, facilitating inventors’ access to the European patent system and its related benefits. At the same time, it ensures the strengthening of intellectual property rights protection, reduction of cases of their infringement and increase of legal certainty for patent holders.

The draft law also aims to optimize the procedures for examining patent applications, correct inconsistencies that have arisen in the application of the current law and align the national protection system with modern requirements in the field.

The amendments are aimed at stimulating interest in research and development, especially in the pharmaceutical and phytosanitary sectors, thereby contributing to the country’s economic progress, based on innovation and competitiveness.
