The Government approved today, November 26, 2025, the Draft Law amending Certain Normative Acts (adjustment of the normative framework in the field of trade secret protection), presented during the meeting by Mr. Eugeniu RUSU, Director General of AGEPI.
The normative act aims to introduce editorial changes, necessary to correlate the legislative acts in force with the provisions of Law No 384/2023 on the Protection of Trade Secrets, which transposes into national legislation Directive (EU) 2016/943 on the protection of undiscloded know-how and business information (trade secrets) against their unlawful acquisition, use and disclosure. In particular, the draft proposes to adjust certain normative acts that contain references to repealed acts or outdated terminologies, so that they correspond to the new adopted law. The amendments aim to standardize the terms used and correctly define the concepts related to trade secrets and the legal regime applicable to them.
The proposed regulatory interventions do not introduce new procedures and do not require special implementation measures, being of an exclusively technical and legislative alignment nature.
The necessary adjustments at the level of Government decisions have already been made by Government Decision No 587/2025 amending Certain Government Decisions (adjustment of the normativey framework in the field of trade secret protection), which entered into force on October 12, 2025.
The draft law approved today is to be submitted to Parliament for examination.
