The State Agency on Intellectual Property (AGEPI) informs interested parties about the initiation of the procedure for the designation of the collector of remunerations for the right to compensatory remuneration for reprography and the right to retransmission, for a new period of three years.

The procedure was initiated following the expiration, on October 23, 2026, of the three-year period for which the Public Association “Association for Reproduction Rights” (ADERO) was designated as the collector of remunerations for the aforementioned rights.

The designation procedure is carried out in accordance with Art. 103 of Law No 230/2022 on Copyright and Related Rights.

In this context, AGEPI invited all collective management organizations approved for the respective fields and rights to submit, within 30 days from the date of notification:

1. A joint proposal for the designation of the collector, indicating the organization proposed for each of the rights concerned, in accordance with Art. 103 paragraph (2) of Law No 230/2022; or

2. The documents and supporting information necessary for the designation of the collector by AGEPI, according to Art. 103 paragraph (5) of the same Law, demonstrating the fulfillment of the following criteria:

• the existence of a monitoring programme for the use of works and a remuneration distribution system;
• the representativeness of the organization, determined according to the number of members and the degree of use of the managed repertoire;
• the availability of the necessary human and material resources to ensure the efficient collection of remuneration, with a minimum level of expenditure.

If the organizations concerned do not submit a joint proposal, AGEPI will examine the submitted supporting documents and verify the cumulative fulfillment of the conditions and criteria provided for in Art. 103 paragraph (5) of Law No 230/2022.

We emphasize that in order to ensure the collection of remunerations due to authors and rightholders for the right to compensatory remuneration for reprography and the right to retransmission, AGEPI will issue the decisions to designate the collector, maintaining the continuity of the designation period without interruption, in accordance with the provisions of the legislation in force.
