August 26, 2026, Chisinau – The State Agency on Intellectual Property (AGEPI) continues the necessary procedures for the designation of the collector of remuneration for mandatory collectively managed rights or through extended collective management. In parallel, collective management organizations will be able to submit proposals for improving the legislative framework regulating this area.
The next steps were discussed during a working meeting organized at the initiative of AGEPI, with the participation of representatives of the approved collective management organizations and the joint collection structure, the Ministry of Justice and the Agency.
“The designation of the collector is a priority for AGEPI. We have a responsibility to complete this procedure in a transparent, fair and legally sound manner, so that the collection mechanism functions in the interest of authors and all rightholders,” said Natalia Mogol, Acting Director of AGEPI.
The participants analyzed the current state of the appointment procedure, including the administrative steps completed in recent months and the legal situation of the organizations that can participate in this process. Currently, the designation procedure is suspended in connection with an ongoing control procedure. AGEPI is to complete the step that determined this suspension, so that the designation procedure can continue.
The evolution of the process was also influenced by the related administrative and judicial procedures that arose during the examination of some AGEPI decisions. These required the completion of the stages provided for by law before a final decision was adopted. AGEPI is ready to advance the procedure, and compliance with deadlines and procedural obligations by all parties involved are important to avoid delays.
During the discussions, representatives of collective management organizations also pointed out challenges in the application of the current provisions of Law No 230/2022 on Copyright and Related Rights, including with regard to the functioning of the collective management mechanism and the collection of remuneration. The parties agreed on the need to examine them and formulate legislative solutions.
Representatives of the Ministry of Justice present at the meeting informed the participants that the process of amending Law No 230/2022 is already underway, both to improve the collective management system and to continue the harmonization of the legislation of the Republic of Moldova with the acquis of the European Union. Collective management organizations and other stakeholders are encouraged to contribute with concrete proposals resulting from the experience of applying the law.
AGEPI emphasizes that the designation of the collector involves verifying the capacity of the organization that will manage the collection of remunerations, including its capacity to ensure a transparent collection and distribution mechanism. Completing these checks is necessary for the decision adopted to be legal, well-founded and to provide real guarantees to rightholders.
