Press Release on the Suspension of the Activity of the Public Association “AUTORITY” as a Collective Copyright Management Organization

The State Agency on Intellectual Property (AGEPI) informs rightholders, users of works and other protected objects, as well as all interested persons about the adoption of Decision No 28/967 of 11.06.2026 on the suspension of the activity of the Public Association “AUTORITY” as a collective copyright management organization.

The measure was ordered in accordance with Art. 107 para. (1) point c) of Law No 230/2022 on Copyright and Related Rights, as a result of the failure to comply with the measures established by AGEPI Decision No 25/574 of 03.04.2026.

By the aforesaid decision, AGEPI, taking into account the conclusions and recommendations formulated in the Control Act No 1/518 of 25.03.2026 of the Commission for the Control of the Activity of Collective Management Organizations and the Common Collection Structure within AGEPI on the general control of the activity of the Public Association “AUTORITY” for the period January 1, 2024 - December 31, 2024, requested the Public Association “AUTORITY” to undertake, by April 10, 2026, a set of measures aimed at eliminating the irregularities identified during the control carried out and ensuring the compliance of its activity with the requirements of the legislation in force.

Since the ordered measures were not implemented within the established deadline, AGEPI ordered the suspension of the activity of the Public Association “AUTORITY” as a collective management organization for a period of six months from the date of issuance of Decision No 28/967 of 11.06.2026.

During the suspension, the Public Association “AUTORITY” cannot exercise the specific duties of a collective management organization provided for by Law No 230/2022 on Copyright and Related Rights, including concluding license agreements with users, collecting remuneration as a collective management organization, issuing licenses for the use of works and other protected subject-matters, concluding or renewing representation agreements with other collective management organizations and participating in the procedures for designating the collector.

Suspension of the activity of the Public Association “AUTORITY”, approved as a collective management organization according to AGEPI Decision No 2/333 of 06.03.2023, does not affect the legal status of the Public Association “AUTORITY” as a non-commercial organization, conferred in accordance with the provisions of Law No 86/2020 on Non-Commercial Organizations.

According to the provisions of Law No 230/2022 on Copyright and Related Rights, upon the expiration of the suspension period, the measure will cease if the obligations established by AGEPI Decision No 25/574 of 03.04.2026 are fulfilled. In the event that these obligations are not fulfilled, AGEPI will apply the measures provided for by the legislation, including the revocation of the decision to approve the collective management organization.

Decision No 28/967 of 11.06.2026 entered into force on the date of issuance and may be challenged by submitting a prior application to AGEPI, under the conditions provided for by the Administrative Code of the Republic of Moldova No 116/2018 and by Law No 230/2022 on Copyright and Related Rights.

AGEPI exercises the powers of approval, monitoring and control of the activity of collective management organizations pursuant to Art. 7 para. (2) points s), u) and v) of Law No 114/2014 on the State Agency on Intellectual Property. In exercising these powers, the Agency monitors compliance with the legal requirements applicable to collective management organizations and applies the measures provided for by the legislation in case of irregularities.

Through its supervisory and control actions, AGEPI aims to strengthen a transparent, efficient and legally compliant collective management system for the benefit of authors, performers, producers and other rightholders, as well as users of works and other protected subject-matters. The Agency will continue to ensure the uniform application of legislation and the proper functioning of collective management mechanisms for copyright and related rights in the Republic of Moldova.
