On April 23, 2010, the Parliament of the Republic of Moldova voted for the proclamation of April 27 as the State Flag Day. The Tricolor was designated the official State Flag of the Republic of Moldova on 27 April 1990 by the first parliament deputies.

The legal framework for public symbols is the Constitution of the Republic of Moldova, Law No. 86 of 28.07.2011 on Public Symbols and international treaties to which the Republic of Moldova is party. Law on Public Symbols governs legal relations pertaining to registration, legal protection and use of public symbols afferent to the domains: heraldic, vexillological, hymnological, sigillographic, faleristic and uniformistic.

National flag of the Republic of Moldova is also protected in accordance with Article 6ter of the Paris Convention for the Protection of Industrial Property of March 20, 1883, to which the Republic of Moldova is party. Article 6ter of the Paris Convention shall apply to all 174 Member States of the Convention and the Member States of the World Trade Organization, independent of whether or not members of the said Convention, by the Agreement concerning commercial aspects of intellectual property rights (TRIPS).

According to Article 6ter of the Paris Convention on the protection of state emblems, official hallmarks, full names and abbreviations of intergovernmental organizations, “The countries of the Union agree to refuse or to invalidate the registration, and to prohibit by appropriate measures the use, without authorization by the competent authorities, either as trademarks or as elements of trademarks, of armorial bearings, flags, and other State emblems, of the countries of the Union, official signs and hallmarks indicating control and warranty adopted by them, and any imitation from a heraldic point of view”.

In our country, the competent authority which grants permission to use the State Flag image is the Parliament of the Republic of Moldova.

On April 27, 2012, in accordance with the Government indication, in all educational institutions of the country at the first hour will be held one educational hour on the given subject. Also, at the initiative of Prime Minister Vlad FILAT, on the occasion of the Flag Day the Government will transmit to all educational institutions in the country a copy of the encyclopedic edition “National Symbols of the Republic of Moldova”. The work was published in 2011 by the Institute for Encyclopaedic Research of the Academy of Sciences of Moldova, as a result of events on the occasion of the 20th anniversary since the adoption of the Tricolor as the State Flag of the Republic of Moldova.
